Dermaluxe Spa Terms of Service
1. Acceptance of Terms
By accessing or utilizing any services by Dermaluxe Spa, located in Houston, Texas, you explicitly agree to be bound by these comprehensive Terms of Service. These terms constitute a legally binding agreement between you (the client) and Dermaluxe Spa, governing all interactions, services, and transactions.
2. Service Agreements
2.1 Service Descriptions
All spa services are described on our website and at our physical location. Dermaluxe Spa reserves the absolute right to modify, discontinue, or update service offerings without prior notice. Descriptions of services are not guaranteed to be completely exhaustive and may be subject to change.
2.2 Service Limitations
Our services are intended for individuals 18 years and older. Minors must be accompanied by a legal guardian. We reserve the right to refuse service to any individual for any reason, including but not limited to inappropriate behavior, medical contraindications, or potential safety concerns.
3. Financial Terms
3.1 Payment Policies
All payments are due immediately upon service completion. Dermaluxe Spa accepts the following payment methods:
- Major credit cards (Visa, MasterCard, American Express, Discover)
- Apple Pay
- Cash
- Care Credit
3.2 Pricing
Pricing for all services is subject to change without prior notification. The price in effect at the time of service will be the applicable charge.
3.3 Cancellation and Refund Policy
- Cancellations must be made at least 48 hours in advance for new permanent makeup appointments and at least 24 hours in advance for all other scheduled appointments.
- Late cancellations within these time frames will incur a $50 fee.
- No-show appointments will be charged a $50 fee. New permanent makeup clients will forfeit their $100 deposit and be charged an additional $50 fee.
- Refunds are only granted in cases of service failure or clear professional error.
4. Health and Safety Considerations
4.1 Medical Disclosures
Clients are required to disclose all relevant medical conditions, allergies, medications, and health concerns before receiving any treatment. Failure to provide complete medical information absolves Dermaluxe Spa of any liability for adverse reactions.
4.2 Treatment Risks
All spa treatments carry inherent risks. By receiving services, you acknowledge and accept these potential risks. Dermaluxe Spa is not liable for any pre-existing conditions exacerbated during treatment.
5. Intellectual Property
5.1 Content Ownership
All content on our website, marketing materials, and service descriptions are the exclusive intellectual property of Dermaluxe Spa. Reproduction, distribution, or commercial use of this content is strictly prohibited without written consent.
6. Privacy and Data Protection
6.1 Information Usage
Personal information is handled according to our separately published Privacy Policy. By using our services, you consent to our data handling practices.
7. Limitation of Liability
Dermaluxe Spa’s total liability for any claim arising from services shall not exceed the cost of the specific service provided. We are not liable for indirect, consequential, or punitive damages.
8. Dispute Resolution
Any disputes shall be resolved through binding arbitration in Harris County, Texas, in accordance with American Arbitration Association rules. Legal proceedings must be initiated within one year of the alleged incident.
9. Modifications to Terms
Dermaluxe Spa reserves the unconditional right to modify these terms at any time. Continued use of our services constitutes acceptance of any modified terms.
10. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11. Governing Law
These terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
